This document presents the terms of use applicable to access to and use of Aleryos.

1. Purpose

These terms of use, hereinafter the "CGU", govern access to the Aleryos website, game, and services.

Aleryos is a multiplayer online real-time space strategy game in a persistent universe.

The CGU set the general framework for use of the service. The detailed rules of gameplay, conduct, multi-accounting, trade, war, moderation, and sanctions are specified in the game rules.

2. Publisher

The Aleryos service is published by:

Rémy Vahé, sole proprietor, operating under the trade name GeekoS Nexus.

  • SIREN: 812 794 501.
  • SIRET: 812 794 501 00039.
  • Business address: Rue Lt-col Joseph Zanardi, 11100 Narbonne, France.
  • E-mail address: [email protected].
  • VAT: TVA non applicable, article 293 B du Code général des impôts.

3. Acceptance

Creating an account, logging into the game, using the service, or participating in the beta implies acceptance of these CGU.

If the user refuses all or part of the CGU, they must not create an account, log into the game, or use the Aleryos services.

The publisher may require the user to renew their acceptance in the event of a substantial modification of the CGU, the CGV, the game rules, or the privacy policy.

4. Applicable documents

Use of Aleryos is governed by:

  • these CGU;
  • the game rules;
  • the terms of sale applicable to Astrium purchases;
  • the privacy policy;
  • the cookies policy;
  • any specific beta or event conditions.

In the event of a contradiction, the specific conditions applicable to a feature, a test phase, or a purchase take precedence over the general conditions for the point concerned.

Some features may include an internal shop allowing the use of Astrium to obtain digital content or services displayed in-game. Astrium purchases and its use in the internal shop are governed by the CGV.

5. Access to the service

Access to Aleryos requires a compatible device, an internet connection, a recent browser, and the creation of a player account.

The publisher may change the technical specifications necessary for the operation of the game. The user remains responsible for their hardware, internet connection, software, device security, and internet access costs.

The service may be temporarily unavailable in the event of maintenance, updates, technical incidents, overload, attack, provider issues, or security needs.

6. Minimum age and minors

Aleryos is intended for users aged at least 16.

Minors aged 16 to 17 must use the service with the authorization of their legal representative.

Any Astrium purchase made by a minor requires the prior agreement of their legal representative.

The publisher may request closure of an account or limitation of certain features when it appears that the user does not meet the required age or does not have the necessary authorizations.

7. Player account

To play Aleryos, the user must create an account by providing the requested information, including a valid e-mail address, a password, and a username.

The user undertakes to provide accurate information, keep it up to date, and not impersonate a third party.

The user is responsible for the confidentiality of their credentials and for all actions carried out from their account, unless there is proof of fault attributable to the publisher.

The Aleryos account is personal and non-transferable. Sharing, selling, lending, renting, exchanging, or transferring an account is prohibited except with the publisher's explicit written authorization.

8. Fair use and game rules

The user undertakes to use Aleryos fairly, in compliance with the CGU, the game rules, other players, moderation teams, and the balance of the service.

In particular, cheating, bug exploitation, unauthorized multi-accounting, use of scripts or bots, technical attacks against the service, unauthorized access to data or interfaces, harassment, unlawful content, and any behavior intended to circumvent rules or sanctions are prohibited.

The game rules detail the operational rules applicable to accounts, alliances, communications, battles, exchanges, abuse, sanctions, and prohibited behavior.

9. Moderation and sanctions

The publisher may moderate, hide, delete, retain as evidence, or transmit to the competent authorities content and behavior contrary to the CGU, the game rules, or the law.

Moderation may be carried out manually, automatically, or in a hybrid manner.

The publisher may take proportionate measures, including: warning, content deletion, chat limitation, removal of an advantage, freezing of resources, temporary suspension, ban, account closure, or reporting to the competent authorities.

The user may challenge a sanction by e-mail at [email protected] or via the channel provided by support, by setting out the facts and providing the relevant information.

10. Intellectual property and user content

All content produced by the publisher in Aleryos belongs to the publisher or its rights holders: code, databases, interfaces, texts, names, universe, factions, resources, illustrations, ships, buildings, characters, sounds, mechanics, game systems, lore, and documentation.

The user receives only a personal, limited, non-exclusive, non-transferable, and revocable right to access the service and use the game's features in compliance with the CGU.

The user retains their rights to the original content they publish when it is protected by an intellectual property right. By publishing content in Aleryos, the user authorizes the publisher to host it, reproduce it, display it, moderate it, delete it, and make it accessible to other users for the needs of the service.

11. Beta, availability, and evolution of the service

Aleryos may operate in alpha, closed beta, open beta, or early access. During these phases, the game is under active development.

The user acknowledges that the service may contain bugs, interruptions, rapid changes, rule changes, partial resets, or full resets.

The publisher may modify, suspend, or temporarily remove a feature to ensure game balance, security, stability, legal compliance, or improvement of the service.

Unless otherwise provided in the CGV, free resources, in-game resources, rankings, beta progress, items obtained for free, and non-purchased advantages do not constitute vested rights.

Real-money purchases of Astrium and its use in the internal shop are governed by the CGV.

12. Closure of the account or the service

The user may request closure of their account by contacting support at [email protected] or via the interface provided for that purpose.

Closing the account does not automatically result in a refund of purchases already completed, unless otherwise required by law, in the event of lack of conformity, error attributable to the publisher, or a commercial decision by the publisher.

The publisher may terminate all or part of the Aleryos service, in particular in the event of project shutdown, technical, economic, legal, or security constraints. When reasonably possible, the publisher informs users before the definitive closure of the service.

13. Liability

To the extent permitted by law, the publisher is not liable for indirect damages, loss of opportunity, loss of progress, loss of ranking, loss of free virtual resources, loss of in-game reputation, temporary interruptions, technical incompatibilities, or consequences related to non-compliant use of the service.

This clause does not limit the consumer's mandatory rights, the legal guarantee of conformity applicable to paid digital content and services, or the publisher's liability in the event of gross negligence, intentional fault, or bodily injury.

14. Modification of the CGU

The publisher may modify the CGU to reflect the evolution of the service, applicable law, providers, moderation practices, the business model, or technical constraints.

Significant modifications are brought to the attention of users by any useful means. Use of the service after being informed constitutes acceptance of the new CGU, unless the user objects or closes the account under the stated conditions.

15. Applicable law

The CGU are governed by French law.

In the event of a dispute, the user is invited to contact support in order to seek an amicable solution.

The consumer's mandatory rights remain applicable.
